About shipments to provinces and internationally

THE COMPANY offers its products nationwide in the Republic of Peru and internationally. THE CUSTOMER understands and accepts that processing purchase orders entails additional shipping and logistics costs, which will be fully assumed by THE CUSTOMER. THE COMPANY will inform THE CUSTOMER of these costs at the time of purchase.

Validity, validity and stock of the offers contained on this site

Registration of THE CLIENT

Acceptance of these terms and conditions and registration by THE CUSTOMER, with the provision of an access code, will be required for the purchase of products and services offered on this site. These Terms and Conditions will be deemed acknowledged and accepted by the CUSTOMER upon express acceptance by clicking on the corresponding box.
The CUSTOMER's registration will be verified by completing and signing the form available on the site and then submitting it automatically by clicking on the corresponding element. Once registered, the CLIENT will be provided with a username and password or permanent code that will allow personalized, confidential, and secure access. THE CUSTOMER assumes full responsibility for maintaining the confidentiality of their password registered on this website, which allows them to make purchases, request services, and obtain information. This password is for personal use, and sharing it with third parties does not involve liability for THE COMPANY and/or its subsidiaries. Therefore, safeguarding this password is THE CUSTOMER's sole responsibility and is subject to the security measures it implements for its protection.

THE CLIENT'S Rights

THE CUSTOMER shall enjoy all rights in force in the territory of Peru, in particular those established in the Civil and Consumer Protection Code, as well as those additionally granted in these terms and conditions.
THE CUSTOMER shall at all times have the right to information, rectification, erasure, and/or other rights regarding their personal data in accordance with Law No. 29733 – Personal Data Protection Law. Simply visiting this site, where certain goods and services are offered, does not impose any obligation on the consumer, unless they have expressly accepted, through their corresponding acceptance, the conditions offered by THE COMPANY, in the manner indicated in these terms and conditions.
Additionally, THE CLIENT will have access to the virtual complaints book, which is available on THE COMPANY's official website, in accordance with Law No. 29571, Consumer Protection and Defense Code. Regulation DS No. 011-2011-PCM and its amendments.

Procedure for using this website

In the contracts offered through this site, THE COMPANY will clearly and easily inform the consumer of the steps to be followed to enter into them, collectively referred to as the Purchase Procedure. The Purchase Procedure indicated for such purposes on this site for making a purchase is equivalent to accepting that THE COMPANY has effectively complied with the conditions contained in this section. The company will also indicate its postal and email addresses, as well as the technical means available to the consumer to identify and correct errors in the delivery or in their data.
Any information entered incorrectly or omitted by THE CUSTOMER may be considered by THE COMPANY as a null or non-existent purchase. If this occurs, if THE CUSTOMER subsequently makes another purchase, the conditions of our products and/or services could have been affected.

Payment methods that can be used on this site

The products and services offered on this site, unless otherwise indicated for specific cases or offers of certain goods or services, can only be paid for in the following ways:

• Bank deposit. For this type of payment, THE CUSTOMER must make the corresponding deposit to the account number in THE COMPANY's name for the total amount indicated on the purchase order. In this regard, the customer accepts that if this deposit is not completed, the purchase order will not be processed, the availability of the products in said order cannot be guaranteed by THE COMPANY, and therefore the transaction will be canceled due to non-payment.
• Visa, Mastercard, and American Express bank cards, whether national or international, provided that THE CUSTOMER maintains a valid contract with the financial institutions that provide service for said cards. Use of the aforementioned cards will be subject to the provisions of these Terms and Conditions and, in relation to their issuer, to the provisions of the respective Opening Contracts and Rules of Use between THE CUSTOMER and the card issuing institution. In the event of a conflict, the provisions of the latter instrument will prevail.

Regarding bank cards accepted on this site, all aspects related to them, such as issue date, expiration date, limit, blocking, etc., will be governed by the respective Card Opening Agreement and Rules of Use. Therefore, THE COMPANY shall not be liable for any of the aforementioned aspects. The site may specify specific purchase conditions depending on the payment method used by THE CUSTOMER.

Formation of consent in contracts concluded through this site:

Through this website, THE COMPANY will make offers of goods and services, which may be accepted through THE CUSTOMER's consent, using the mechanisms that the site itself offers for this purpose.
Any acceptance of an offer will be subject to the condition precedent that THE COMPANY validates the transaction. Consequently, for any transaction carried out on this site, confirmation and/or validation or verification by THE COMPANY will be required for the formation of consent. To validate the transaction, THE COMPANY must verify:

• That it has, at the time of choosing the product and/or species, if these are in stock.
• Which validates and accepts the payment method offered by THE CLIENT.
• That the data registered by THE CLIENT on the site matches the data provided when making their choice.

Once the validation is complete, THE COMPANY will contact THE CLIENT by telephone or use any means of communication that guarantees proper and timely knowledge of the results, which will be indicated in advance on the same site. Consent will be deemed to have been formed from the moment THE COMPANY successfully completes the validation and informs THE CLIENT.

In accordance with the provisions set forth in the preceding paragraphs, and as a measure to protect the security of transactions, THE COMPANY may void purchases in which the information provided by THE CUSTOMER does not match THE COMPANY's available databases, or for which the aforementioned validation has not been carried out within 48 hours of the purchase order. That is, if it is necessary to contact the account holder, and after 48 hours following the purchase order, this is not possible, THE COMPANY will void said transaction (this as a security measure for THE CUSTOMER), proceeding to communicate this fact to the issuing bank of the credit card used by the consumer at the time of sending their purchase request in the case of using this payment method. The issuing bank of the credit card used to make the purchase request on the site must proceed with the refund of the amount in accordance with its previously agreed policies.

Condition of the products and their packaging

Products purchased through the site will be subject to the conditions accepted by THE CUSTOMER and available on this website.

Dispatch of products

Products purchased through the site will be subject to the dispatch and delivery conditions chosen by THE CUSTOMER and available on this website.
The information regarding the shipping location and the person receiving the product is the sole responsibility of THE CUSTOMER. Unless otherwise stated by THE CUSTOMER, THE COMPANY will assume that the person assisting and/or receiving the product(s) is the person authorized by THE CUSTOMER to accept the purchase.

The delivery times chosen for dispatch and delivery are counted from the date the COMPANY sends written confirmation of payment and transaction, and are considered business days for compliance with said deadline.

About sales of products on request and pre-orders

Some products sold on this website may be purchased upon specific request, also referred to as Pre-Orders. The CUSTOMER understands that these products are not located in the country and must therefore undergo an import process and subsequent customs clearance before arriving in the country. Furthermore, the CUSTOMER is subject to the dispatch and delivery conditions available on this website.
For these types of orders, THE COMPANY will request an advance payment of 50%, 75%, or 100% of the total amount purchased, depending on the type of product and volume, as assessed by THE COMPANY. The difference due will be paid upon arrival in Mexico. The products included in the order will go through the proper logistics process and be delivered to your home, which may take up to 30 business days.
THE CUSTOMER accepts that products purchased under Pre-Order have an estimated availability date, which is subject to change by the product manufacturer, including definitive cancellation due to lack of availability. THE COMPANY therefore reserves the right to change these dates by notifying THE CUSTOMER through any available means, including direct communications to THE CUSTOMER, through social media, and/or in THE COMPANY's online store.
Upon generating the order, THE CLIENT authorizes THE COMPANY to proceed with the import and accepts the purchase amounts in full, upon receipt of the same and will be authorizing THE COMPANY to retain 30% of the total purchase amount as administrative expenses incurred by THE COMPANY, in the event of subsequently withdrawing from the acquisition of the product(s). In the latter, THE COMPANY will not be committed to delivering the order, but if the difference is in favor of THE CLIENT, after the aforementioned retention, within a period of no less than 15 business days to the account number that THE CLIENT will provide.

Warranty, exchanges and returns

Without prejudice to the provisions of the preceding paragraph, in no case of returns will THE COMPANY refund the money paid and, failing that, will apply a credit in favor of THE CUSTOMER that may be used on other products that THE COMPANY offers.
If the CUSTOMER withdraws from the purchase and wishes to cancel their order only before delivery and acceptance, the cancellation may be processed. As indicated in the previous paragraph, a credit will be applied to the CUSTOMER.
The CUSTOMER must meet the general requirements and conditions to submit a request for an exchange and/or return. The request will be evaluated and approved by THE COMPANY in advance, based on whether the product meets the specific conditions for exercising the right of return. In all cases, the return request must be evaluated and approved by THE COMPANY.

Requirements:

• Any change or return must be made within five (5) calendar days from the date the product was received.
• The item must be delivered to the store in its original packaging. It is essential to have the complete product, as delivered, with all its components such as tags, accessories, packaging, original manuals in good condition, and the product with no signs of use or opening.
• If the products present a verified factory defect within 5 days of receipt, the customer will be assisted with the replacement of the unit.
• It is essential to present proof of purchase (electronic receipt/invoice) in case of loss or misplacement, it is important to file a police report.
• Present your ID card, Foreigner's Card or Passport.
• For products associated with a promotion (combos), all products included in the promotion must be delivered; otherwise, the exchange or refund will not be processed.
• THE CUSTOMER must send the product to the address indicated by THE COMPANY.

Please note that if the product(s) are not in their original packaging, the exchange will not be accepted. Exchanges will also not be accepted if the CUSTOMER does not have proof of payment (a copy of the receipt/electronic invoice), which must be submitted.
Important: Not all brands offer the option to request a refund due to a change of mind. Therefore, it is THE CUSTOMER'S responsibility to check the product's return policies and/or contact a customer service advisor provided by THE COMPANY before making the purchase and accepting the product(s).

Use of personal data registered on the site

The personal data referred to in these terms and conditions will be used to validate purchase orders and improve the information, advertising, and marketing of the products and services provided by THE COMPANY. Personal data may only be provided to subsidiaries or related companies of THE COMPANY, whether such transfer is to companies incorporated in Peru or abroad. Such transfer may be revoked by THE CUSTOMER, and therefore, their ability to purchase products in the Virtual Store will be limited.
Any communication that THE CLIENT receives from this Website will contain an address or a valid mechanism by which they may request suspension of communications. Once THE CLIENT requests that further communications not be sent, they will not receive additional information, in accordance with Law No. 28493 – Law Regulating the Use of Unsolicited Email and Law 29733 – Personal Data Protection Law and its Regulations.

Territory

This site has been built, is controlled, and is operated by THE COMPANY from Peruvian territory, and therefore complies with and is fully governed by the laws of the Republic of Peru. Any dispute arising from this site, its contents, its operation, etc., must be processed and resolved by the Peruvian courts. The parties waive the jurisdiction of their domiciles and establish their domicile as the district of Lima-Cercado.

Regulations

The CLIENT agrees to comply with the provisions of this contract. In the event of any gaps or aspects not regulated by this document, the provisions of the Civil Code and the Consumer Protection Code shall apply as a supplement.

Conflict resolution

Any dispute arising from or in connection with this Agreement, including a dispute regarding the validity or existence of this Agreement, shall be resolved through arbitration proceedings in Lima, conducted by a single arbitrator in accordance with the applicable law of the Arbitration Center of the Lima Chamber of Commerce. The Parties waive any right to appeal or similar proceedings against the arbitration award.
For any supplementary intervention by the Judiciary, the parties establish the district of Lima-Cercado as their domicile. THE CLIENT declares that they have read and fully understood the terms and conditions set forth above, and expressly agree to and accept them.
